Terms of Service

These Terms of Service govern your use of La Calabaza AI Dance at https://lacalabazadance.org. By using the service, you agree to them.

The Service

La Calabaza AI Dance lets you upload 1 to 3 photos and generate a short video with AI in the style of the La Calabaza trend. It is an independent tool and is not affiliated with, endorsed by or sponsored by TikTok, ByteDance, CapCut, the creators of the original clip (including @meowtakeover), Pumpky or the song’s artists.

Who Can Use It

You must be at least 13 years old, or the minimum age in your country if that is higher, to use La Calabaza AI Dance. You sign in with a Google account and are responsible for everything done with your account.

What You May Upload

• Photos of yourself, of people who have agreed to be in your video, or of your pets.
• Everyone shown in your photos must be 18 or older and must have agreed to it, unless it’s you.
• No photos of celebrities or public figures.

Acceptable Use

You agree not to use La Calabaza AI Dance to:

• impersonate anyone or pass off a video as real footage of a person;
• create sexual, violent, hateful or harassing content;
• commit fraud or spread disinformation;
• infringe anyone’s copyright, trademark, privacy or publicity rights;
• attack, overload or reverse-engineer the service.

We may remove content, block generations or suspend accounts that break these rules.

Your Content

You keep the rights you have in the photos you upload. You give us a limited license to store and process them only to provide the service to you.

The Sound in Your Video

Every video carries an excerpt of the La Calabaza trend’s sound. All rights in the sound and the song stay with their owners. That means your video is for personal, non-commercial sharing, for example on your own social media accounts, and not for ads, sponsored posts or other commercial use. Label your video as AI-generated wherever that is required, including on TikTok.

AI Output

AI results vary. We don’t guarantee that a video will look exactly like your photo or meet a particular purpose, so check it before you share it.

Credits and Payments

• Prices are shown before you pay. Payments are one-time and processed by Stripe.
• Credits you buy in packs never expire.
• Payments are non-refundable, except where the law requires otherwise.
• If a generation fails, the credits it used are returned to your account automatically.

Termination

You can stop using La Calabaza AI Dance at any time. We may suspend or end your access if you break these Terms or if we need to for legal or security reasons.

Disclaimers and Limitation of Liability

The service is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

Changes to These Terms

We may update these Terms. If you keep using La Calabaza AI Dance after a change takes effect, you accept the updated Terms.
